The Delhi Consumer Forum recently levied a large penalty on Flipkart and a product manufacturer for failure to deliver the right products and neglecting consumers’ problems. This case speaks of the rising responsibility of online services to provide appropriate service. A customer from Delhi was delivered the wrong product and when he tried to resolve the issue, Flipkart denied the request. The consumer forum decided in favor of the customers, arguing that large service providers must always ensure they place customers’ interests at the center of their services.
The case was connected to a consumer from Najafgarh, Delhi, who bought a Bluetooth headset in November 2021. He unpacked it, and what he found in the package was a wired headset. Even after lodging a complaint, Flipkart insisted they were not capable of returning the product since the request was made later than the 48-hour return guarantee.
The forum determined that Flipkart’s refusal to address the customer’s grievance was unjust. The consumer, Lalit Kumar, had found the wrong item and reported the issue right away. To his dismay, Flipkart discarded his complaint because of its strict policy. In response, Flipkart said that the item was sold by one of its third sellers, and thus, the mistake did not fall under their jurisdiction.
However, the forum rejected this argument, emphasizing that as the platform facilitating the sale, Flipkart held accountability for the customer’s purchase experience.
This fine is imposed to serve as a means of putting a face to the fact that the consumer had to put up with a terrible ordeal. This decision supports one of the coherent policies of cooperation, which is that the platform that is involved in online shopping owes something to the customer and is answerable for those services that are unsatisfactory because of the participation of the third sellers.
This case also points to the fact that technological advances in e-commerce businesses generate new legal needs for offering sufficient protection to consumers and developing effective solutions to the problems their clients face.
